GENERAL TERMS & CONDITIONS
1.1 Notice of Terms
This website is owned and operated by Bully Breed Kennel Club. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers members the ability to register their dogs to build/continue pedigree lines, register litters of puppies by those dogs and have the kennel they are housed in registered. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
1.2 Purchase Agreement
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.
1.4 Change of Service
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Bully Breed Kennel Club. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
1.6 Uploading of Media
You recognise and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and documents) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website and related social media pages owned by Bully Breed Kennel Club.
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.
You agree to indemnify and hold Michael Keating (Owner & CEO of Bully Breed Kennel Club) harmless from any demands, loss, liability, claims or expenses (including legal fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
To the maximum extent permitted by applicable law, in no event shall Michael Keating (Owner & CEO of Bully Breed Kennel Club), be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Michael Keating (Owner & CEO of Bully Breed Kennel Club) assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
1.9 Change of Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in England. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
TERMS & CONDITIONS RELATING TO FORM APPLICATIONS
2.1 Applicants Details
Applicants will act as sole point of contact for all aspects of the Registration(s).
Applicants Details must be present and correct at time of form submission.
The Home Address provided by the applicant will be the address used to send all documents regarding the Registration(s).
Your Unique ID Number will be sent to you within 24 hours of registering an account.
Unique ID Number will be sent to you for your personal use only. This number cannot be used by anyone else other than you when filling out applications.
2.2 Joint Owners Details
Joint Owners details must be submitted on the Application Form. (They cannot be added after the application has been processed).
Joint Owners can request Document copies of:
Dog’s Registration Certificate
Kennel Name Registration Certificate
(Display copies of Certificates are limited to 1 copy of each. These will be sent to the applicant, and will list the applicants name first and all other owners secondary).
2.3 Dogs Details
All details of the dog being registered must be present and correct at the time of submission.(All form fields marked * are required and form will not be able to be submitted unless filled in.
Details submitted are final and cannot be altered or changed unless in exceptional circumstances e.g Dog was not de-sexed at time of registration but has been at a time after.
A Registered Name must follow the rules set below or may be rejected:
A Name must consist of no more than 24 characters this includes spaces
Names can only contain letters and spaces no punctuation, numbers or symbols allowed.
Canine terms such as “Dog”, “Bitch”, “Champion”, and full names of breeds are not permitted.
If the dog is registered to a kennel that the applicant owns, the kennel's name may be used in the dogs name being applied for. (Kennel name will show on the dog's certificate under the registered name so it does not need to be in the name if you don't want it to).
All names are subject to profanity checks and availability against our database, if the name(s) you requested are not available you will be contacted to provide an alternative or make changes to the name submitted if possible.
Registered company names, trademarks and owners surnames are not permitted in registered names.
2.4 Kennel Names
Kennel Name Registration
A Kennel Name application must follow the rules set below or may be rejected:
Requested names may contain up to 20 characters including spaces.
Can only be made up from letters and numbers and spaces. No form of punctuation or symbols are allowed.
No personal names are allowed to be used in the name.
Common place names, Registered company and trademark names cannot be used.
All Names submitted are subject to profanity checks and availability checks against our database. We reserve the right to reject any name that may cause offense to others, please wait to receive a confirmation email to say your name choice has been approved before using it on other applications. The email will be sent out as soon as your choice of name has been approved, you will also receive your Kennel Number that will be required on Dog and Litter Registrations.
If your choice of name is not available you will be asked to give an alternative or modify the name you applied for if possible.
You are only allowed to have one Kennel Name registered to you.
Kennel Name on Dog Registration
Kennel names must be registered before any dog can be added under them.
The applicant on the Dogs Registration must be an owner listed on the Kennel Name registration for it to be applied.
Kennel Name on Litter Registration
Applicants who have a BBKC registered Kennel Name should enter the name and number on the Litter Registration Form. Kennel Names cannot be applied after submitting.
The Dam must be owned by one of the people listed on the Kennel’s owners Certificate.
2.5 Litter Registration
The person(s) registering the litter must be the registered owner(s) of the dam at date of birth of litter. The address used to register the litter must be the address the puppies were born, and all documentation will be sent to this address.
In the case of joint ownership of the dam, the person filling out the application will be the person contacted in regards to the application and any documents will be sent to them.
All joint owners will be credited on all documents pertaining to the litter, however one copy of the Litter Certificate will be sent to the person making the registration. If joint owners would like a copy of this they can contact us via online contact form or email to request a copy at the price stated on the Price List page
Applications may be rejected if any of the following terms are not followed.
The dam and sire must both be BBKC registered to be able to register the litter.
The dam is under the age of 12 months when breeding took place.
The dam is over the age of 8 years on the litter date of birth.
The dam has had more than 5 litters or the dam has had a litter within the last 2 years.
The offspring are the result of breeding between father and daughter, mother and son or brother and sister.
2.6 Dams Details
The details submitted regarding the dam and her details about the mating and pregnancy must be correct at the time of submitting. Failure to comply with this could result in removal of dams and puppies pedigree.
2.7 Sires Owners Details
The Sire’s owner(s) on the litter registration must be the registered owner(s) of the dog. The sire must have a BBKC Registration in place to be able to register the litter.
The owner(s) of the sire can request a copy of the Litter Certificate at the cost stated on the Price List page , they will need to provide the litter registration number that will be emailed to the email address provided in the sire’s details section of the form.
2.8 Sires Details
The details submitted regarding the sire and his details about the mating must be correct at the time of submitting. Failure to comply with this could result in removal of sires and puppies pedigree.
2.9 Birth Details
(See Sections 2.6 & 2.8).
2.10 Puppies Details
Puppies can be registered from 8 weeks of age and should be registered before 6 months of age. Puppies older than 6 months will be subject to a late registration fee stated on the Price List page.
All puppies details must be correct at time of registration (See Sections 2.6 & 2.8).
Certificates are not proof of ownership of a dog. They are proof of ownership of the registration of that dog.
We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.
When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.
We collect such Non-personal and Personal Information for the following purposes:
To provide and operate the Services;
To provide our Users with ongoing customer assistance and technical support;
To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;
To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;
To comply with any applicable laws and regulations.
Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.
All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.
